ARTICLE 1: GENERAL PROVISIONS

The e-commerce website of Dear Vinyl, a BVBA with registered office at Weineveld 6, 8020 Hertsberge VAT BE 0715447056, RPR Brugge, hereinafter ('Dear Vinyl'), offers its customers the opportunity to purchase the products from its webshop online.
These General Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through the Dear Vinyl online store, the Customer must explicitly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. DearVinyl are accepted.

ARTICLE 2: PRICE

All prices quoted are expressed in EURO, always including VAT and all other duties or taxes that are obligatory to be borne by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The price quotation only refers to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.

ARTICLE 3: OFFER

Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind Dear Vinyl. Dear Vinyl is only bound to an obligation of means in terms of the correctness and completeness of the information provided. Dear Vinyl is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.
The offer is valid while stocks last and can be adjusted or withdrawn at any time by Dear Vinyl. Dear Vinyl cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

ARTICLE 4: ONLINE PURCHASES

Placing a purchase is done by pressing the "order" button.
All ordered products are placed in the shopping cart.
At checkout you will be asked for the customer's details.
Then we go to send via "proceed to send". Here is an overview of the shipping address and shipping costs.
If agreed, we will proceed to pay via the "Go to pay" button.
The customer has the choice between different payment options.
If agreed, we press the "complete order" button and the order is confirmed.

The Customer can choose between the following payment methods

  • via credit card
  • via bank card
  • via ideal

Dear Vinly is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement

Once payment has been confirmed and received, we proceed to the delivery procedure.
Product will be shipped to the stated address within 5 working days, unless stated otherwise.
Delivery costs are as stated on the site. When ordering more than 50 euros, delivery is free within Belgium. For orders from the Netherlands, shipping is free for an amount of more than 100 euros.
For countries outside the Netherlands or Belgium, the delivery costs are adjusted to the country of shipment.
Delivery is made by DPD, unless stated otherwise.
Unless otherwise agreed or explicitly stated otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.
Any visible damage and / or qualitative shortcoming of an article or other shortcoming in delivery must be reported by the Customer to Dear Vinyl without delay.
The risk of loss or damage is transferred to the Customer when he (or a third party designated by him, who is not the carrier) has physically taken possession of the goods. However, the risk is transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by the Dear Vinyl.

Article 6: Retention of title

The delivered items remain the exclusive property of Dear Vinyl until full payment has been made by the Customer.
The Customer undertakes, if necessary, to inform third parties of the retention of title of Dear Vinyl, for example to anyone who would seize the articles not fully paid for.

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from Dear Vinyl.

The Customer has the right to withdraw from the agreement within 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good. ";

To exercise the right of withdrawal, the Customer must inform Dear Vinyl, Weineveld 6, 8020 Hertsberge, hello@dearvinyl.com, by an unambiguous statement (e.g. in writing by post, fax or e-mail) of his decision to withdraw from the agreement. The Customer can use the enclosed model withdrawal form, but is not obliged to do so.

In order to meet the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Dear Vinyl, Weineveld 6, 8020 Hertsberge or to. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods will be borne by the Customer.

If the returned product is in any way impaired, Dear Vinyl reserves the right to make the Customer liable and to claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond necessary to determine the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer cancels the agreement, Dear Vinly will refund all payments received from the Customer up to that time, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after Dear Vinyl has been informed of the Customer's decision to withdraw from the agreement. In addition, Dear Vinly can wait with the reimbursement until it has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Dear Vinyl will not be reimbursed.

Dear Vinyl pays the Customer back with the same payment method with which the Customer carried out the original transaction, unless the Customer has explicitly agreed otherwise; in any case, no costs will be charged to the Customer for such reimbursement.

Article 8: Warranty

Under the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer Home, the Customer must contact DearVinyl customer service and return the item to Wear Vinyl at his expense.

If a defect is found, the Customer must inform Dear Vinyl as soon as possible. In any case, any defect must be reported by the Customer within 2 months after it has been established, after which time any right to repair or replacement will lapse.

The (commercial and / or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the product. item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable, delivery, are deemed not to be hidden defects, unless proof to the contrary by the Customer.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights held by DearVinyl, in the event of non-payment or late payment from the date of the breach of contract, the Customer is legally obliged to pay interest of 10% per year on the unpaid amount without notice. and without notice a flat-rate compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Notwithstanding the foregoing, Dear Vinyl reserves the right to take back items that have not been (fully) paid for.

Article 11: Privacy

The controller, Dear Vinyl, respects the Belgian law of December 8, 1992 with regard to the protection of privacy in the processing of personal data.
The personal data you provide will only be used to process the order.
You have a legal right to inspect and, if necessary, correct your personal data. Article 14: Change of conditions

These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of Wear Vinyl. In the event of any conflict, these Terms and Conditions will prevail.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.
Dear Vinyl has subscribed to the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to UNIZO's complaints procedure is available via http://www.unizo.be/ecommercelabel/.

Article 16: Applicable law - Disputes

Belgian law is applicable, with the exception of the provisions of private international law regarding applicable law.
The courts of the Consumer's place of residence have jurisdiction in legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
